Terms of Service

1. Agreement to Terms

By purchasing a product, subscribing to a care plan, or engaging Simplee Creative ("we," "us," "our") for services, you ("client," "you") agree to these Terms of Service. If you don't agree, please don't use our services or purchase from our store.

2. Services We Provide

Simplee Creative offers website design and development, logo and brand identity design, graphic design, social media management, and ready-made website integrations (available through our Store), along with ongoing website care plans covering hosting, security, and content updates.

3. Project Work & Custom Builds

For custom projects — websites, logos, brand identity — the specific scope, timeline, and deliverables are agreed upon directly with you before work begins, typically through a written quote or project agreement. These Terms govern our general relationship; a specific project agreement may include additional terms, which take precedence over these Terms where the two conflict.

4. Payment Terms

• One-time purchases — including Store products and website buyouts — are charged in full at the time of purchase through our payment processor, Stripe.
• Monthly care plans are billed automatically on a recurring monthly basis until cancelled.
• Prices are listed in U.S. dollars. We reserve the right to change our prices at any time; changes won't affect an active subscription until your next billing cycle, and we'll do our best to give advance notice.

5. Subscriptions & Cancellation

Monthly care plans (Starter Care, Growth Care, Pro Care) renew automatically each month. You may cancel at any time through your billing portal (linked in the footer of this site) or by contacting us directly. Cancellation takes effect at the end of your current billing period — you'll keep access to your plan's services through the period you've already paid for. We don't provide refunds for partial billing periods.

6. Refunds

Store products and website buyouts: because these involve custom installation and work on your behalf, we don't offer refunds once work has begun. If something isn't working as described, contact us first — we'll make it right.

Monthly care plans: no refunds for the current billing period, but you're free to cancel at any time to stop future charges.

If you believe you were charged in error, contact us at simpleecreative.com@gmail.com and we'll sort it out.

7. Intellectual Property

• Once a custom project — like a Full Website Buyout — is paid in full, the final delivered files are yours to keep and use as you see fit.
• Store integrations (like the Window Tint Selector) are licensed for use on the website they're installed on. The underlying code and design remain the property of Simplee Creative and may not be resold, redistributed, or reused on other projects without our permission.
• We retain the right to showcase completed work — including screenshots and links — in our own portfolio and marketing, unless you ask us not to.

8. Your Responsibilities

To keep your project moving and your care plan effective, we ask that you provide timely feedback, any content, logins, or access we need to do the work, and let us know promptly about any issues with your site or service.

9. Limitation of Liability

We do our best work, but Simplee Creative isn't liable for indirect, incidental, or consequential damages arising from use of our websites, integrations, or services — including lost revenue, lost data, or downtime — beyond the amount you've paid us for the relevant service. Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Termination

We reserve the right to suspend or terminate service to any client who violates these Terms, engages in abusive conduct, or fails to pay for services rendered.

11. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent version. Continued use of our services after changes means you accept the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Nebraska, without regard to conflict of law principles.
